LEGISLATIVE CHANGES TO CHIP:
The Nebraska State Legislature recently made changes to CHIP that are effective August 30th, 2009.
-
For new applicants, if you are eligible for comparable group coverage, Medicare by reason of age, or Medicaid, or if you already have other comparable coverage, you are not eligible for CHIP. If you currently have CHIP, you will not be terminated even if you are eligible for, or already have, comparable health insurance coverage.
- Also effective August 30th, 2009, CHIP premiums must be paid by either the policy holder, an individual related to the policy holder by blood, marriage or adoption, or an entity operating under the federal Ryan White HIV / AIDS Treatment Modernization Act of 2006.
- Your premiums can still be paid by your employer if proof can be provided that the cost of the premiums is borne entirely by the policy holder. Proof can come in the form of paystubs or a letter from your employer.
- Additionally, if you are self-employed, you may also continue to pay your premiums via a business checking account if your name is on the check or if proof is provided that you are the business owner and are either the policy holder or an individual related to the policy holder by blood, marriage or adoption.
- Other changes were made to CHIP under LB 358. Those changes can be viewed here.
If you are offered COBRA at a rate higher than CHIP, you will not be automatically eligible for Nebraska CHIP until the COBRA period has been exhausted (typically 18 months). If you have been diagnosed with a Nebraska CHIP specified condition, this exclusion is waived. However, you will have a six-month waiting period for pre-existing conditions. The specified conditions are listed on the application and here.
